Board Attorney

Owner's Associations (HOAs) are run by homeowners with limited business and
legal knowledge and they are unfamiliar with policies and procedures of running
a non-profit corporation. We assist Board members in properly running their HOA
in accordance with State and Federal laws. We advise Boards throughout Pennsylvania, and have
written numerous By-Laws and covenants on their behalf. In addition, most associations hold at least
one meeting per year for the membership of the HOA. Others meet more
often. The board of directors for most HOA's
meet on a monthly or as needed basis. We
recommend an Attorney attend all membership meetings and when necessary board
meetings. Further, board members may be
required to attend other business meetings, such as with a developer or other
contractor. An attorney from our Firm can be available to attend any such
meeting, if given proper notice.
Bylaws and Other
Documents - We are experienced in drafting and amending association Bylaws. In addition we draft and revise various other
documents, including, articles of incorporation, contracts, regulations and rules. Further we can assist in interpreting and
provide our legal opinion for such documents in accordance with State and
Federal law.
Enforcement of Noncompliance - We assist
HOA's in successfully enforcing their regulations against members who violate
their contractual obligations contained within the bylaws, regulations or rules
of the community. This is accomplished
through fines and when necessary, through court intervention. When such litigation is necessary we can
assist the association in obtaining court intervention to force compliance with
association documents.
Collections of Debts - You pay your HOA dues, and so should
all other members of the community.
Therefore, we take an aggressive approach to collecting delinquent dues.
We have found that being aggressive in regards to collection policy reaps the
greatest reward and deters others from ever becoming delinquent. Collection
costs and attorney fees should always be paid by the delinquent party, and
should always be a part of your bylaws in regards to collecting debts. We offer
a variety of collection methods for the recovery of delinquent dues.
Litigation - We have extensive experience in representing associations
in all litigation matters. We have litigated collection matters, violation of
regulations and complex construction defect cases. We can represent your HOA whether you are plaintiff
or defendant, during trial or on appeal.
